Sell your Tulsa rental house, tenants and all

Great tenants, terrible tenants, or tenants who stopped paying three months ago. If you want to sell a house with tenants in Tulsa, you don't have to wait for the lease to end or win an eviction first. For over 25 years we've bought Tulsa-area rentals as-is, with the tenants still in place, on the timeline you pick.

  • We buy with tenants in place, leases and all
  • No evictions, repairs or turnover needed first
  • No commissions or closing costs

Being a landlord sounded like passive income

Then the 2 a.m. water heater call happened. Then the tenant who "forgot" rent for the third month in a row. Then the turnover that cost more than a year of cash flow. If you're tired of being a landlord, you're in good company. We're landlords too, so we get it.

Our job is to listen, explain your options in plain English, and help you pick the one that's best for you. Sometimes that's selling to us. Sometimes it's hiring a good property manager and keeping the house, and we'll tell you so. We help people, not just houses.

Can you sell a house with tenants in it in Oklahoma?

Yes. Selling a rental with tenants still living there is common, and it's usually simpler than people expect. Here's the short version:

  • The lease generally stays with the house. A sale doesn't end a lease. The tenants usually stay under their current terms, and the buyer becomes their new landlord.
  • The security deposit moves with it. Deposits are typically transferred to the buyer at closing, so the money is there when the tenant eventually moves out.
  • Showings need notice. Oklahoma generally requires one day's notice before a landlord enters, except in emergencies. Listing means a lot of entries. Selling to us means one walkthrough at a time that works for your tenant.
  • Month-to-month is more flexible. If there's no lease term left, you may be able to end the tenancy with proper written notice. If there is one, the buyer takes it over.

Lease terms and situations vary, so if anything is unusual, like an option to buy in the lease, loop in an Oklahoma real estate attorney.

Sell with tenants, or wait until they move out?

There's more than one right answer. Here's how they compare.

Wait, fix it up, list it empty

An empty, updated house can attract buyers who plan to live there, and that can mean a higher price. But you'll lose rent while it sits, pay for the turnover and repairs, and carry the taxes and insurance until it sells. A great fit if the tenant is leaving anyway and the house is in good shape.

List it with tenants in place

Your buyers will mostly be investors who care about the rent and the lease. Showings depend on your tenant's cooperation, and a messy or unhappy tenant can scare buyers off. A great fit for a well-kept rental with a solid tenant and good rent.

Sell it to us

Our offer is below full retail, and we'll always say that plainly. In exchange: tenants stay put, no evictions, no repairs, no turnover, no showings, and you pick the date. If you're flexible on how or when you receive your equity, we can often offer more.

Problem or non-paying tenants?

Behind on rent, damaging the place, or just impossible to deal with. Before you spend months and money fighting it out, here's what an eviction in Tulsa usually looks like:

  • 1. Written notice. For unpaid rent, Oklahoma generally requires a written 5-day notice to pay before you can end the tenancy. Other lease violations usually come with a longer window to fix the problem.
  • 2. File the case. If they don't pay or leave, you file an eviction case, called forcible entry and detainer, in Tulsa County District Court.
  • 3. The hearing. Oklahoma law generally sets the hearing 5 to 10 days after the summons is issued, as long as the tenant can be served.
  • 4. Move-out order. If you win, the court can issue an order that gives the tenant 48 hours to leave. You can't change the locks or put their things out yourself.

How long does it take to evict someone in Oklahoma? A smooth, uncontested case often takes a few weeks. A tenant who can't be found, fights the case, or files a counterclaim can stretch it out. What does it cost? Court filing, sheriff service and move-out order fees run a couple hundred dollars, before attorney fees, lost rent and repairs.

Or skip it. We can often buy with the tenant still in the house, or with the eviction already in progress, and handle it from there. Sometimes the cleanest path is "cash for keys," where the tenant gets paid to move out by an agreed date. It's often faster and cheaper than court, and we're happy to handle that conversation after we buy.

This is general information, not legal advice. Eviction rules change and every case is different, so talk to an Oklahoma attorney about yours.

Own a Tulsa rental from out of state?

Managing a house from three states away is its own special kind of stress. You're relying on texts from the tenant, photos from the handyman, and a property manager's word that the roof is "probably fine."

You don't need to fly in to sell it. We'll handle the walkthrough with your tenant or property manager, send you a written offer, and the title company can usually handle signing by mail or with a mobile notary wherever you live. If the house came to you through an estate, see our page on selling an inherited rental.

Tired of being a landlord? A few signs it might be time

  • The rent barely covers the mortgage, taxes and insurance anymore
  • A big repair is coming: roof, HVAC, sewer line, foundation
  • You dread your phone ringing
  • The tenant is behind and you're tired of chasing it
  • Your property manager costs more than they're worth
  • You moved away and can't keep an eye on it
  • You inherited it and never wanted to be a landlord
  • You'd rather have the equity working somewhere else

None of those mean you have to sell. But if three or four of them made you nod, it's worth a no-pressure conversation. Your call.

What about taxes when you sell a rental?

Selling a rental isn't taxed like selling your own home, so it's worth understanding before you sign anything. The big three:

  • Capital gains. The profit over what you paid, plus improvements, is generally taxable. The home-sale exclusion that covers many homeowners usually doesn't apply to a pure rental.
  • Depreciation recapture. The depreciation you deducted while renting it out can come back as taxable income when you sell.
  • 1031 exchange. If you reinvest in another investment property and follow the rules and deadlines, you may be able to put off some or all of that tax.

We're not CPAs, and nothing here is tax advice. But we've been part of plenty of rental sales, and we're glad to talk through how yours might play out, including timing and closing dates, so you walk into your CPA's office with good questions and a clear picture.

How selling a rental with tenants to us works

Four steps, and no obligation at any point.

  1. Tell us about the rental

Call, text, or fill out the form. Rent, lease terms, and the honest truth about the tenant situation.

    About 5 minutes
  2. One walkthrough

We set a time that works for you and your tenant, with proper notice. If you're out of state, we'll coordinate it.

    Usually within a few days
  3. You get a written offer

A fair cash offer, in writing. Run it by your CPA, your partner, or anyone you trust.

    No obligation to accept
  4. You pick the closing date

We close through a licensed title company. The lease and deposit transfer to us, and you're officially off landlord duty.

    As fast as 14 days

Rental and tenant questions we get a lot

Can I sell my house with tenants in it?

Yes. In Oklahoma a lease generally stays with the house when it sells, so the tenants usually stay and the buyer becomes their new landlord. We buy rentals with tenants in place all the time.

What happens to my tenants when the rental is sold?

Usually not much changes for them. The lease generally carries over to the new owner, rent gets paid to the new owner, and the security deposit is typically transferred to the buyer at closing so it's there when the tenant moves out.

Do I have to tell my tenants I'm selling?

It's the right thing to do, and you'll need to give notice before anyone enters for a walkthrough. Oklahoma generally requires one day's notice before a landlord enters, except in emergencies. With us, it's one walkthrough at a time that works for your tenant.

Is it better to sell a rental with or without tenants?

It depends. An empty, fixed-up house can attract buyers who plan to live there and may bring a higher price, but you'll lose rent while it sits and pay for the turnover. A house with tenants mostly appeals to investors, who care about the rent. We'll walk through the numbers with you.

How long does it take to evict someone in Oklahoma?

An uncontested eviction for unpaid rent often takes a few weeks from the 5-day notice to the tenant moving out. A contested case, a missed service, or a jury demand can stretch it longer. Talk to an attorney about your specific case.

Can you buy my rental in the middle of an eviction?

Often, yes. We can buy with the eviction still in progress or with the tenant still in the house, so you can be done with it instead of waiting on the court.

What about capital gains and depreciation recapture?

Selling a rental can bring capital gains tax and depreciation recapture, and a 1031 exchange may let you put off some of it if you buy another property. We're not CPAs and this isn't tax advice, but we've been part of plenty of rental sales and we're glad to talk through how yours might play out so you walk into your CPA's office with good questions.

Can I sell my rental to my tenant?

You can, and sometimes it's a great fit. The catch is that many tenants can't get financing quickly. If that doesn't work out, we're happy to make you an offer as a backup.

Am I obligated if I ask for an offer?

Nope. Get our offer, compare it to your other options, sleep on it, or walk away. We won't chase you.

Let's talk it through
